24/7 Program

The 24-7 Program is located at the Marshall County Sheriff’s Office.

Testing Hours for UAs are 8:00am- 5:00pm.

Testing Hours for PBTs are dependent on the participant’s schedule (case-by-case basis).

No Travel Advisories will excuse the client from testing.  This includes residing in, or traveling through an area with an No Travel Advisory.  In Marshall County, those advisories are generally reviewed at 7AM & 7PM.
If a No Travel Advisory be issued, the client is still required to call MCSO and check-in.  These advisories for Marshall County will be posted on SD511.org and MCSO/MCEM Facebook Pages.

The program is used as a bond condition, sentence condition, or as part of probation or parole. The program may also be used as a tool/resource for non-criminal issues.

The length of time spent testing with the program is determined by the Judges, Court Services officers and Parole agents on a case-by-case basis.

PBTs are conducted at MCSO.  Generally, participants are required to test twice daily, 12 hours apart.  MCSO strives to make testing as easy as possible for clients, so we don’t have a retired time specifically set aside for this testing.
We still follow the 12-hour apart testing requirement (unless otherwise approved by the Court).

Urinary Analysis (UAs) are also conducted at MCSO.  Generally, participants are required to test twice weekly, unless otherwise mandated by the Court or Court Services Officer (Parole/Probation).
Day(s) for UA testing is Monday & Thursday OR Tuesday & Friday (8a-5p).

MCSO offers alternatives to PBTs & UAs.
Remote Breath (RB) is the alternative to PBTs.  This allows the client to test as required, but uses a portable device.  The device is not much bigger than a cell phone and uses LTE to transmit test results to MCSO.
A Drug Patch is the alternative to UAs.  As the name suggests, a drug patch is worn for 10-14 days and obtains sweat samples from the participant. The patch is then sent for testing.

Costs for testing is the responsibility of the participant. Clients are required to keep current with any fees associated with the Program.  Any fees paid, but not used, will be reimbursed to the client upon completion of the Program.
PBT- $30 State Fee & $1 for every test.  (The State Fee is spread out over the first 30 days and only paid once.)
UA- $10 for every test.  Should a presumptive positive result occur, further testing costs will be assigned to the client at the current rate.
RB- $5/day.  $80 Agency Fee is assessed for the Install/Uninstall process.
Drug Patch- $50/patch (2 weeks).

In the event that a person tests positive in the program, does not show up for their required tests or does not abide by the rules of the Program, the participant may be taken into custody or a warrant may be issued for their arrest.

The 24/7 Program is a State-wide Program that is administered by local law enforcement agencies.
